Terms and Conditions for AfterClass

Welcome to AfterClass (https://www.afterclasstw.com). By accessing or using our website and services, you agree to these Terms and Conditions (“Terms”).

These Terms are provided in both English and Chinese for convenience. In the event of any inconsistency or discrepancy, the English version shall prevail.

ENGLISH VERSION (Authoritative)

1. Overview
AfterClass is a web-based service that helps users upload audio/video files and receive: (a) an English transcript, (b) a Traditional Chinese translation, and (c) an optional bilingual (English/Chinese) formatted version. Output quality may vary depending on audio quality and content.

2. Accounts
To use certain features, you may need to sign in (e.g., via Google). You are responsible for maintaining the security of your account and for all activity under your account.

3. Credits / Minutes
a) The service is usage-based. Your account may have a balance of “minutes” (credits) that are used when processing files.
b) Minutes required are based on the detected/estimated duration of the uploaded media and the rounding rules shown in the product.
c) We may implement safeguards to prevent duplicate charging and may restore minutes in certain failure scenarios (e.g., transcription failure). However, we do not guarantee that every failure can be fully reversed in all edge cases.

4. Uploads, Storage, and Deletion Policy
a) You confirm you have the rights to upload and process the files you submit.
b) For cost and performance reasons, uploaded media files may be deleted automatically after processing, while text outputs may be retained for later access. If file retention is available, the retention period (if any) will be stated in the product.
c) You should keep your own backup of original files. We are not responsible for loss of original files once deletion occurs.

5. Payments and Refunds
a) Payments are processed by Stripe. We do not store your full payment card details.
b) Purchases add minutes/credits according to the plan you select.
c) Refunds (if any) are handled case-by-case, taking into account usage, fraud, or accidental purchases. Unless required by applicable law, we do not guarantee refunds once credits have been delivered and/or used.
d) Chargebacks/disputes may result in account restrictions, reversal of credits, or suspension, where permitted by law and payment processor rules.

6. Acceptable Use
You agree not to use the service to:
- violate any laws or third-party rights,
- upload malware or harmful content,
- attempt to disrupt the service or bypass limits,
- engage in fraud or abuse (including payment abuse).

7. Privacy
We process personal data (e.g., account identifiers, email, and payment-related metadata) and non-personal data (e.g., cookies, device data) as described in our Privacy Policy: https://www.afterclasstw.com/privacy-policy

8. Disclaimer
The service is provided “as is” and “as available”. We do not warrant that the service will be uninterrupted, secure, or error-free, or that transcripts/translations will be fully accurate.

9. Limitation of Liability
To the maximum extent permitted by law, AfterClass and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business opportunities. If liability cannot be excluded, it is limited to the amount you paid to us in the relevant period, to the extent permitted by law.

10. Changes to the Service and Terms
We may update the service and these Terms from time to time. We will post the updated Terms on this page and may notify users via email or in-product notice.

11. Governing Law
These Terms are governed by the laws of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

AfterClass 是一個網頁服務，協助使用者上傳音訊/影片檔並取得：(a) 英文逐字稿、(b) 繁體中文翻譯、(c)（可選）中英對照排版版本。輸出品質會受到音質與內容影響，可能有所差異。

2. 帳戶
使用部分功能可能需要登入（例如 Google 登入）。你需自行保護帳戶安全，並對帳戶下的所有行為負責。

3. 點數 / 分鐘
a) 本服務採用用量制，你的帳戶可能有「分鐘數」（點數）餘額，用於處理檔案。
b) 需要扣除的分鐘數以系統偵測/估算的音訊時長與產品顯示的進位規則為準。
c) 我們可能會加入防重複扣款機制，並在某些失敗情境（例如轉錄失敗）嘗試返還分鐘數；但在所有邊緣情況下，我們不保證一定能完整返還。

4. 上傳、儲存與刪除政策
a) 你確認擁有上傳與處理你所提交檔案的權利。
b) 為了成本與效能，原始上傳檔案可能在處理完成後自動刪除，而文字輸出可能保留供你日後查看；若有提供保留期限，將以產品中顯示的說明為準。
c) 請自行備份原始檔案。原始檔案一旦依政策刪除，我們不對其遺失負責。

5. 付款與退款
a) 付款由 Stripe 處理，我們不會儲存完整信用卡資訊。
b) 購買方案會依你選擇的方案新增分鐘數/點數。
c) 退款（如有）將依個案處理，並考量使用情況、詐欺風險或誤購等因素。除非法律另有規定，一旦點數已交付或已使用，原則上不保證退款。
d) 若發生退款爭議/拒付（chargeback），在法律與金流規範允許的範圍內，我們可能限制帳戶、扣回點數或暫停服務。

6. 可接受使用規範
你不得將本服務用於：
- 違反法律或侵害第三方權利，
- 上傳惡意程式或危害內容，
- 破壞服務或繞過限制，
- 任何詐欺或濫用行為（含付款濫用）。

7. 隱私
我們可能處理個人資料（例如帳戶識別資訊、Email、付款相關 metadata）與非個人資料（例如 cookies、裝置資訊），詳情請見隱私權政策：https://www.afterclasstw.com/privacy-policy

8. 免責聲明
本服務以「現狀」與「可用狀態」提供。我們不保證服務不中斷、完全安全或無錯誤，也不保證逐字稿/翻譯內容完全正確。

9. 責任限制
在法律允許的最大範圍內，AfterClass 及其營運者不對任何間接、附帶、特殊、衍生性損害，或資料/利潤/商機損失負責。若法律不允許完全免責，責任上限以你在相關期間支付給我們的金額為限（在法律允許的範圍內）。

11. 準據法
本條款適用澳洲法律。你同意接受澳洲聯邦及新南威爾斯州法院之非專屬管轄。
